1. Introduction

20-2 Logistics Consultants LLC (“Company,” “We,” “Us,” or “Our”) is committed to protecting the privacy and security of the personal and business information of users of the 20-2 Dispatch platform (the “Platform”). This Privacy Policy describes how we collect, use, disclose, store, and protect information when you access or use the Platform, and your rights and choices regarding such information.

By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with the practices described herein, you should not access or use the Platform.

2. Information We Collect

2.1 Information You Provide Directly

We collect information that you voluntarily provide when you register for, access, or use the Platform, including:

  • Account Information: Name, email address, phone number, company name, job title, and other information provided during registration or account setup.
  • Organizational Information: Company name, MC/DOT number, business address, billing address, and other organizational details.
  • Operational Data: Load and shipment details, carrier information, customer information, rate and financial data, documents, notes, communications, and all other data entered into or generated through the Platform in the course of your freight brokerage operations.
  • Payment Information: Billing address and payment method details provided through our third-party payment processor. We do not directly store complete payment card numbers on our systems.
  • Communications: Messages, emails, support requests, feedback, and other communications you send to us or through the Platform.

2.2 Information Collected Automatically

When you access or use the Platform, we may automatically collect certain technical and usage information, including:

  • Device and Browser Information: IP address, browser type and version, operating system, device type, screen resolution, and unique device identifiers.
  • Usage Data: Pages visited, features used, actions taken, time spent on pages, click patterns, search queries, and other interaction data.
  • Log Data: Server logs, error reports, access timestamps, and referring URLs.
  • Cookies and Similar Technologies: We may use cookies, web beacons, pixels, and similar tracking technologies to collect information about your use of the Platform, maintain session state, and improve your experience. You may manage cookie preferences through your browser settings, though disabling cookies may affect Platform functionality.

2.3 Information from Third Parties

We may receive information about you or your Organization from third-party sources, including Technology Providers, identity verification services, public databases (such as FMCSA SAFER), and business partners. We may combine this information with information we collect directly from you.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Providing and Operating the Platform: To deliver, maintain, and improve the Platform and its features, including AI-powered features, load management, carrier management, invoicing, and all other Platform functionalities.
  • AI Processing: To transmit relevant operational data to AI Technology Providers for the purpose of generating AI-powered responses, suggestions, and outputs as described in the Terms of Service. See Section 5 below for detailed information about AI data processing.
  • Communications: To send you transactional messages, operational notifications, service updates, security alerts, and support communications. We may also send you marketing communications with your consent, which you may opt out of at any time.
  • Billing and Payments: To process payments, manage subscriptions, generate invoices, and maintain billing records.
  • Security and Fraud Prevention: To detect, prevent, and respond to security incidents, fraud, abuse, and other harmful activities.
  • Legal Compliance: To comply with applicable laws, regulations, legal processes, and governmental requests.
  • Analytics and Improvement: To analyze usage patterns, diagnose technical issues, and improve the Platform's performance, features, and user experience. We may use aggregated and anonymized data for these purposes.
  • Customer Support: To respond to your inquiries, troubleshoot problems, and provide technical assistance.

4. How We Share Your Information

We do not sell your personal information to third parties. We may share your information in the following circumstances:

  • Technology Providers (Sub-processors): We share data with the Technology Providers described in the Terms of Service solely to the extent necessary to provide Platform features and services. Each Technology Provider is contractually obligated to use your data only for the purposes specified and in accordance with applicable data protection standards.
  • Within Your Organization: Information you enter into the Platform may be visible to other authorized users within your Organization, subject to the role-based access controls configured by your Organization administrator.
  • Legal Requirements: We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that such disclosure is necessary to protect our rights, your safety, the safety of others, or to investigate fraud or respond to a government request.
  • Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, your information may be transferred to the successor entity, subject to the commitments made in this Privacy Policy.
  • With Your Consent: We may share your information with third parties when you have given us explicit consent to do so.
  • Aggregated and Anonymized Data: We may share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify you for analytics, research, industry benchmarking, or other purposes.

5. AI-Powered Data Processing

5.1 What Data Is Processed by AI

When you use AI-enabled features within the Platform, certain categories of your operational data may be transmitted to our AI Technology Providers (currently Anthropic and OpenAI) for processing. The specific data transmitted depends on the feature being used and the context of your interaction, but may include any of the data categories described in Section 3.3 of the Terms of Service.

5.2 How AI Providers Handle Your Data

All AI Technology Providers used by the Platform are accessed through commercial API agreements that include the following protections:

  • No Model Training: Your data is not used to train, fine-tune, or improve the AI provider's models or services. Your data is used solely to generate responses within the Platform.
  • Temporary Retention Only: AI providers temporarily retain transmitted data for a limited period (currently up to 30 days) for operational integrity and abuse-prevention purposes, after which the data is automatically deleted.
  • No Third-Party Sharing: AI providers do not share your data with third parties for their own commercial purposes.
  • Security: Data is transmitted to AI providers using industry-standard encryption protocols (TLS/SSL) and processed in accordance with the provider's enterprise-grade security standards.

5.3 Your Choices Regarding AI Processing

You and your Organization administrator have the following choices regarding AI data processing:

  • Disable AI Features: Organization administrators can disable AI-powered features for the entire Organization through administrative settings. Individual users may also be able to disable AI features for their own accounts, subject to organizational permissions.
  • Selective Use: Users may choose to use or not use specific AI-powered features on a feature-by-feature basis where such controls are available.

When AI features are disabled, no operational data will be transmitted to AI Technology Providers. Core Platform functionality that does not rely on AI will remain available.

6. Data Retention

We retain your information for as long as your account is active, as necessary to provide you with the Platform, or as required to fulfill the purposes described in this Privacy Policy. Specifically:

  • Account and Operational Data: Retained for the duration of your account and for a commercially reasonable period thereafter to allow for data export, account reactivation, or compliance with legal obligations.
  • AI Processing Data: Transmitted to AI providers in real time and retained by those providers for no more than 30 days before automatic deletion, as described in the Terms of Service.
  • Billing and Financial Records: Retained for a minimum of seven (7) years in accordance with applicable tax and financial reporting requirements, or longer if required by law.
  • Log and Usage Data: Retained for up to twenty-four (24) months for security, analytics, and troubleshooting purposes.
  • Backup Data: Database backups are maintained for disaster recovery purposes and are retained for a commercially reasonable period. Deleted data may persist in backup archives until the backup retention period expires.

Upon account termination, we will delete or anonymize your data in accordance with our standard data retention practices, subject to any legal or regulatory retention requirements.

7. Data Security

We implement commercially reasonable security measures designed to protect your information, including:

  • Encryption of data in transit (TLS/SSL) and at rest
  • Role-based access controls and multi-tenant data isolation
  • Secure authentication mechanisms including password hashing
  • Regular security assessments and monitoring
  • Access logging and audit trails
  • Incident response procedures

While we strive to protect your information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security, and you acknowledge and accept this inherent risk when using the Platform.

8. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights regarding your personal information, including:

  • Access: The right to request a copy of the personal information we hold about you.
  • Correction: The right to request correction of inaccurate or incomplete personal information.
  • Deletion: The right to request deletion of your personal information, subject to certain exceptions (such as legal retention requirements).
  • Data Portability: The right to receive your data in a structured, commonly used, and machine-readable format.
  • Opt-Out: The right to opt out of certain data processing activities, including AI-powered features and marketing communications.
  • Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.

9. State-Specific Privacy Rights

Residents of certain states, including but not limited to California (CCPA/CPRA), Texas (TDPSA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and other states with comprehensive privacy legislation, may have additional rights under applicable state law. These may include the right to know what personal information is collected, the right to opt out of the sale or sharing of personal information (we do not sell personal information), and the right to limit the use of sensitive personal information.

10. Children's Privacy

The Platform is not intended for use by individuals under the age of eighteen (18). We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected personal information from a child under 18, we will take commercially reasonable steps to delete such information promptly.

11. International Data Transfers

The Platform is hosted and operated in the United States. If you access the Platform from outside the United States, you acknowledge and consent to the transfer of your data to the United States, where data protection laws may differ from those in your jurisdiction. We will take commercially reasonable steps to ensure that your data is treated securely and in accordance with this Privacy Policy regardless of where it is processed.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. We will notify you of material changes by posting the updated Privacy Policy on the Platform with a revised “Last Updated” date, and may also notify you via email or in-app notification for significant changes. Your continued use of the Platform after any such changes constitutes your acceptance of the updated Privacy Policy.
